Neither. It would probably(hypothetically) be considered theft of services. It would be a civil issue, not criminal.

It's only rape if there is a question concerning consent. The "business" end of things has nothing to do with the later.

If prostitution was legal I would think it would count at theft AND rape and they would give it it's only little fancy offense name. But since it's not, i would think it rape. The only problem is that, if the buyer can prove that it was previously agreed on then they're both screwed. If the seller cannot prove that it ever happened, then the seller is screwed.
